Unfortunately, for residents of my district and many others in the Northeast, New York City-based JetBlue Airlines \u2014 and its impending acquisition of Spirit Airlines \u2014 is standing in the way.<br><br>Last week\u2019s revelation that JetBlue plans to raise prices on Spirit Airlines routes&nbsp;<a href=\"https:\/\/iqconnect.house.gov\/iqextranet\/iqClickTrk.aspx?&amp;cid=NY13AE&amp;crop=15413.49695960.5178183.1472232&amp;report_id=&amp;redirect=https%3a%2f%2fwww.usatoday.com%2fstory%2ftravel%2fairline-news%2f2023%2f08%2f24%2fjetblue-spirit-airlines-fare-raise%2f70670093007%2f&amp;redir_log=932362198921705\" rel=\"noreferrer noopener\" target=\"_blank\">by up to 40%<\/a>&nbsp;if its merger with Spirit goes through is appalling; however, it is not unexpected. Rather, it is just the latest chapter in JetBlue\u2019s ongoing saga to undermine free markets at the expense of consumers, and it\u2019s time Americans took notice.&nbsp;<br>&nbsp;<br>Like other airlines, JetBlue&nbsp;<a href=\"https:\/\/iqconnect.house.gov\/iqextranet\/iqClickTrk.aspx?&amp;cid=NY13AE&amp;crop=15413.49695960.5178183.1472232&amp;report_id=&amp;redirect=https%3a%2f%2fwww.forbes.com%2fsites%2fdanielreed%2f2021%2f01%2f28%2famerican-southwest--jetblue-all-report-huge-fourth-quarter-2020-losses%2f%3fsh%3d3f88cc4e7679&amp;redir_log=029170746412917\" rel=\"noreferrer noopener\" target=\"_blank\">incurred heavy losses<\/a>&nbsp;during the COVID-19 pandemic. Yet, instead of working to recoup these losses by innovating and outworking its competitors, JetBlue has spent the past few years trying to shortcut airline competition altogether.<br><br>In 2020, JetBlue commenced its \u201cNortheast Alliance\u201d with another top domestic airline \u2014 an anticompetitive partnership which resulted in these two airlines booking passengers on each other\u2019s flights, sharing airport gates, and splitting revenue in the New York and Boston markets. Recognizing this as a dangerous regional monopoly, the DOJ filed suit in&nbsp;<a href=\"https:\/\/iqconnect.house.gov\/iqextranet\/iqClickTrk.aspx?&amp;cid=NY13AE&amp;crop=15413.49695960.5178183.1472232&amp;report_id=&amp;redirect=https%3a%2f%2fwww.justice.gov%2fopa%2fpr%2fjustice-department-sues-block-unprecedented-domestic-alliance-between-american-airlines-and&amp;redir_log=220029992229860\" rel=\"noreferrer noopener\" target=\"_blank\">September 2021<\/a>&nbsp;to unwind the Northeast Alliance. According to the DOJ\u2019s calculations, JetBlue\u2019s Northeast Alliance may have cost travelers in the Northeast approximately&nbsp;<a href=\"https:\/\/iqconnect.house.gov\/iqextranet\/iqClickTrk.aspx?&amp;cid=NY13AE&amp;crop=15413.49695960.5178183.1472232&amp;report_id=&amp;redirect=https%3a%2f%2fwww.latimes.com%2fbusiness%2fstory%2f2022-09-27%2famerican-jetblue-alliance-will-cost-consumers-700-million-a-year-doj-argues&amp;redir_log=143137887221854\" rel=\"noreferrer noopener\" target=\"_blank\">$700 million<\/a>&nbsp;in higher airfare prices annually.<\/p>\n\n\n\n<p>Mercifully,&nbsp;<a href=\"https:\/\/iqconnect.house.gov\/iqextranet\/iqClickTrk.aspx?&amp;cid=NY13AE&amp;crop=15413.49695960.5178183.1472232&amp;report_id=&amp;redirect=https%3a%2f%2fstorage.courtlistener.com%2frecap%2fgov.uscourts.mad.238255%2fgov.uscourts.mad.238255.344.0_2.pdf&amp;redir_log=323977302822638\" rel=\"noreferrer noopener\" target=\"_blank\">on May 19<\/a>&nbsp;a federal court struck down the Northeast Alliance as anticompetitive, holding that the Alliance allowed JetBlue and its supposed competitor to effectively \u201cfunction as a single airline\u201d in the Northeast.<br><br>In&nbsp;<a href=\"https:\/\/iqconnect.house.gov\/iqextranet\/iqClickTrk.aspx?&amp;cid=NY13AE&amp;crop=15413.49695960.5178183.1472232&amp;report_id=&amp;redirect=https%3a%2f%2fwww.npr.org%2f2022%2f07%2f28%2f1114335468%2fjetblue-wins-the-bidding-war-for-spirit-airlines&amp;redir_log=974094842586607\" rel=\"noreferrer noopener\" target=\"_blank\">July 2022<\/a>, while this initial DOJ antitrust lawsuit was still pending, JetBlue finalized its ignominious hostile takeover of Spirit Airlines \u2014 a deal which was&nbsp;<a href=\"https:\/\/iqconnect.house.gov\/iqextranet\/iqClickTrk.aspx?&amp;cid=NY13AE&amp;crop=15413.49695960.5178183.1472232&amp;report_id=&amp;redirect=https%3a%2f%2fwww.cnbc.com%2f2022%2f05%2f02%2fspirit-board-rejects-jetblue-takeover-offer-on-antitrust-risks.html&amp;redir_log=654899498109691\" rel=\"noreferrer noopener\" target=\"_blank\">initially rejected<\/a>&nbsp;by Spirit\u2019s board of directors based on antitrust concerns. Unsurprisingly, JetBlue\u2019s actions resulted in the DOJ filing a second antitrust lawsuit against JetBlue in&nbsp;<a href=\"https:\/\/iqconnect.house.gov\/iqextranet\/iqClickTrk.aspx?&amp;cid=NY13AE&amp;crop=15413.49695960.5178183.1472232&amp;report_id=&amp;redirect=https%3a%2f%2fwww.justice.gov%2fopa%2fpr%2fjustice-department-sues-block-jetblue-s-proposed-acquisition-spirit&amp;redir_log=670050955137697\" rel=\"noreferrer noopener\" target=\"_blank\">March 2023<\/a>&nbsp;to block this merger.<\/p>\n\n\n\n<p>JetBlue\u2019s acquisition of Spirit Airlines would be disastrous for U.S. travelers. According to&nbsp;<a href=\"https:\/\/iqconnect.house.gov\/iqextranet\/iqClickTrk.aspx?&amp;cid=NY13AE&amp;crop=15413.49695960.5178183.1472232&amp;report_id=&amp;redirect=https%3a%2f%2fdoi.org%2f10.1016%2fj.jairtraman.2017.03.012&amp;redir_log=575469987363286\" rel=\"noreferrer noopener\" target=\"_blank\">an MIT study<\/a>, the presence of a single \u201cultra-low-cost carrier\u201d on a U.S. flight route decreases the average price of all other flights on that route by 21%. Spirit is by far the largest U.S. ultra-low-cost carrier,&nbsp;<a href=\"https:\/\/iqconnect.house.gov\/iqextranet\/iqClickTrk.aspx?&amp;cid=NY13AE&amp;crop=15413.49695960.5178183.1472232&amp;report_id=&amp;redirect=https%3a%2f%2fwww.cnbc.com%2f2022%2f05%2f02%2fspirit-board-rejects-jetblue-takeover-offer-on-antitrust-risks.html&amp;redir_log=654899498109691\" rel=\"noreferrer noopener\" target=\"_blank\">controlling about half&nbsp;<\/a>the ultra-low-cost market. Given JetBlue\u2019s stated desire to purchase Spirit to&nbsp;<a href=\"https:\/\/iqconnect.house.gov\/iqextranet\/iqClickTrk.aspx?&amp;cid=NY13AE&amp;crop=15413.49695960.5178183.1472232&amp;report_id=&amp;redirect=https%3a%2f%2fwww.cnbc.com%2f2022%2f07%2f28%2fjetblue-airways-reaches-deal-to-buy-spirit-airlines.html&amp;redir_log=489523327775608\" rel=\"noreferrer noopener\" target=\"_blank\">\u201cbuild a bigger JetBlue,\u201d<\/a>&nbsp;logic dictates that this merger will inevitably raise prices on Spirit\u2019s current flight routes.<br>&nbsp;<br>Yet, despite common-sense logic, JetBlue has steadfastly claimed that its merger with Spirit would benefit consumers \u2014 which brings us to last week. According to court filings that were improperly redacted by JetBlue\u2019s lawyers, JetBlue accidentally revealed to the world that \u2014 should it merge with Spirit \u2014 it plans to raise fares on current Spirit flight routes&nbsp;<a href=\"https:\/\/iqconnect.house.gov\/iqextranet\/iqClickTrk.aspx?&amp;cid=NY13AE&amp;crop=15413.49695960.5178183.1472232&amp;report_id=&amp;redirect=https%3a%2f%2fwww.barrons.com%2farticles%2fjetblue-spirit-airlines-fares-hike-court-error-merger-stock-ef1ed3d&amp;redir_log=599096902901697\" rel=\"noreferrer noopener\" target=\"_blank\">by at least 24%<\/a>, with&nbsp;increases&nbsp;<a href=\"https:\/\/iqconnect.house.gov\/iqextranet\/iqClickTrk.aspx?&amp;cid=NY13AE&amp;crop=15413.49695960.5178183.1472232&amp;report_id=&amp;redirect=https%3a%2f%2fwww.usatoday.com%2fstory%2ftravel%2fairline-news%2f2023%2f08%2f24%2fjetblue-spirit-airlines-fare-raise%2f70670093007%2f&amp;redir_log=932362198921705\" rel=\"noreferrer noopener\" target=\"_blank\">as high as 40% on some routes<\/a>. While JetBlue claims that these internal documents were \u201c<a href=\"https:\/\/iqconnect.house.gov\/iqextranet\/iqClickTrk.aspx?&amp;cid=NY13AE&amp;crop=15413.49695960.5178183.1472232&amp;report_id=&amp;redirect=https%3a%2f%2fbuffalonews.com%2fbusiness%2fin-court-documents-jetblue-says-it-could-raise-fares-on-some-routes-after-buying-spirit%2farticle_58501b4e-f6fe-5f2b-8249-f3f885b85c60.html&amp;redir_log=111080881991123\" rel=\"noreferrer noopener\" target=\"_blank\">taken out of context<\/a>,\u201d the company\u2019s history of anticompetitive and self-serving behavior proves otherwise.<br><br>In 2020, immediately after receiving $935 million in COVID-19 bailout funds to help airline employees remain afloat during the pandemic, JetBlue went ahead and contravened Congress\u2019 intent by&nbsp;<a href=\"https:\/\/iqconnect.house.gov\/iqextranet\/iqClickTrk.aspx?&amp;cid=NY13AE&amp;crop=15413.49695960.5178183.1472232&amp;report_id=&amp;redirect=https%3a%2f%2fwww.reuters.com%2farticle%2fhealth-coronavirus-usa-airlines%2fu-s-senators-urge-delta-jetblue-to-backtrack-on-employee-hour-cuts-idUSL1N2D31OY&amp;redir_log=090421389992987\" rel=\"noreferrer noopener\" target=\"_blank\">cutting employee pay and benefits<\/a>. Additionally, in 2022, while the DOJ\u2019s Northeast Alliance lawsuit against JetBlue was still pending, JetBlue brazenly announced that it&nbsp;<a href=\"https:\/\/iqconnect.house.gov\/iqextranet\/iqClickTrk.aspx?&amp;cid=NY13AE&amp;crop=15413.49695960.5178183.1472232&amp;report_id=&amp;redirect=https%3a%2f%2faviationweek.com%2fair-transport%2fairports-networks%2famerican-jetblue-grow-northeast-alliance-2023&amp;redir_log=110358124708709\" rel=\"noreferrer noopener\" target=\"_blank\">would be expanding<\/a>&nbsp;its Northeast Alliance to apply to even more flight routes in 2023 \u2014 in overt defiance of the DOJ.<br><br>Fortunately, this behavior would come back to bite JetBlue, as in March 2023, the DOJ\u2019s lawsuit to block JetBlue\u2019s Spirit merger&nbsp;<a href=\"https:\/\/iqconnect.house.gov\/iqextranet\/iqClickTrk.aspx?&amp;cid=NY13AE&amp;crop=15413.49695960.5178183.1472232&amp;report_id=&amp;redirect=https%3a%2f%2fwww.justice.gov%2fopa%2fpr%2fjustice-department-sues-block-jetblue-s-proposed-acquisition-spirit&amp;redir_log=670050955137697\" rel=\"noreferrer noopener\" target=\"_blank\">expressly referenced<\/a>&nbsp;JetBlue\u2019s Northeast Alliance as evidence that JetBlue could not be trusted to behave competitively.
