\u00bfTiene pertinencia o no en Rep\u00fablica Dominicana la reflexi\u00f3n acerca de la necesidad de un nuevo Poder Constituyente? Veamos:<\/p>\n
Despu\u00e9s de la Asamblea Constituyente del 1944, la reuni\u00f3n como Asamblea Constituyente del Congreso electo en los comicios de diciembre de 1962, es lo pol\u00edticamente m\u00e1s cercano al Poder Constituyente fundacional de la Rep\u00fablica Dominicana. <\/p>\n
De esa Asamblea surgi\u00f3 la Constituci\u00f3n de 1963 que sustent\u00f3 una nueva institucionalidad y una agenda en franca contradicci\u00f3n con un poder de facto (olig\u00e1rquico, militar y pro-imperial), opuesto a las libertades, soberan\u00eda y reformas sociales consagradas en ella.<\/p>\n
Esa contradicci\u00f3n determin\u00f3 el golpe reaccionario del 1963 que derroc\u00f3 el gobierno de Bosch y la Constituci\u00f3n de 1963, seguido en abril de 1965 del inicio triunfal de una revoluci\u00f3n popular, democr\u00e1tica y soberana que asumi\u00f3 su restauraci\u00f3n. <\/p>\n
Sin embargo, la invasi\u00f3n militar de EEUU y la contrarrevoluci\u00f3n consolidada meses despu\u00e9s, reinstal\u00f3 el viejo orden colonizador y represivo, obstruyendo por 50 a\u00f1os la transformaci\u00f3n inconclusa.<\/p>\n
Al d\u00eda de hoy la resultante de esa recolonizaci\u00f3n ha sido neoliberalismo empobrecedor y lumpen capitalismo dependiente bajo una dictadura pol\u00edtica y de clase sustentada en la Constituci\u00f3n del 2010, manipulada por las facciones dirigentes del PLD, \u00abpartido \u00fanico de Estado\u00bb (m\u00e1s bien gran corporaci\u00f3n mafiosa asociada a otras menores); carcomida por su creciente decadencia y putrefacci\u00f3n institucional, enfrentada recientemente a una especie de tsunami verde transformador.<\/p>\n
Un sistema as\u00ed, con una institucionalidad y un r\u00e9gimen de partidos generadores de auto-impunidad, obliga a hacerlo colapsar o dimitir mediante una movilizaci\u00f3n multitudinaria de la sociedad que procure establecer un r\u00e9gimen transitorio que convoque a una nueva Asamblea Constituyente Popular y Soberana. <\/p>\n
Nos reta a crear un nuevo Poder Constituyente que opte por reemplazar un sistema de corrupci\u00f3n, impunidad y degradaci\u00f3n ambiental negado a hacer justicia y cambios por la v\u00eda de sus instituciones y mecanismos electorales, todas bajo absoluto y pernicioso control de las fuerzas gobernantes.<\/p>\n
Un Poder Constituyente, que una vez derrotado el carcomido r\u00e9gimen vigente mediante la democracia de calle, tenga como funci\u00f3n b\u00e1sica establecer un orden pol\u00edtico-institucional, econ\u00f3mico-social-cultural basado en libertades, soberan\u00eda, justicia y dignidad humana. <\/p>\n
Ser\u00eda, en consecuencia, una Constituyente dedicada a superar la provisionalidad transitoria y a definir democr\u00e1ticamente la orientaci\u00f3n de la refundaci\u00f3n del pa\u00eds en direcci\u00f3n a conjurar la multi-crisis que estremece esta sociedad y a recrear la legitimidad institucional y el bienestar colectivo. Una Constituyente esencialmente program\u00e1tica. <\/p>\n
Esta nueva lucha pol\u00edtica precisa ver m\u00e1s all\u00e1 de la curva. Necesita un Norte.<\/p>\n<\/p>\n

Is it relevant or not in the Dominican Republic to reflect about the need for a new Constituent Power? Let’s see:<\/p>\n
After the Constitutional Assembly of 1944, the meeting as the Constituent Assembly of the Congress elected in the December 1962 elections is politically the closest to the founding Constituent Power of the Dominican Republic.<\/p>\n
From that Assembly became the 1963 Constitution that underpinned a new institutionalism and an agenda in clear contradiction with a de facto (oligarchic, military and pro-imperial) power, opposed to the freedoms, sovereignty and social reforms enshrined in it.<\/p>\n
This contradiction determined the reactionary coup of 1963 that overthrew the Bosch government and the 1963 Constitution, followed in April 1965 by the triumphal start of a popular, democratic and sovereign revolution that assumed its restoration.<\/p>\n
However, the US military invasion and counterrevolution consolidated months later, reinstalled the old colonizing and repressive order, obstructing for 50 years the unfinished transformation.<\/p>\n
Up to today the result of this recolonization has been the impoverishing neoliberalism and lumpen capitalism under a political and class dictatorship underpinned by the 2010 Constitution, manipulated by the ruling factions of the PLD, \u00absingle party of state\u00bb (rather large Mafia corporation Associated with other minors); worsened by its growing decay and institutional rot, recently facing a kind of transforming green tsunami.<\/p>\n
Such a system, with an institutional system and a regime of parties that generate self-impunity, forces it to collapse or resign by means of a mass mobilization of society that seeks to establish a transitional regime that calls for a new Popular and Sovereign Constituent Assembly.<\/p>\n
It challenges us to create a new Constituent Power that opts to replace a system of corruption, impunity and environmental degradation denied to do justice and changes through its institutions and electoral mechanisms, all under absolute and pernicious control of the ruling forces.<\/p>\n
A Constituent Power, which once defeated the rotten regime in force through street democracy, has as its basic function to establish a political-institutional, economic-social-cultural order based on liberties, sovereignty, justice and human dignity.<\/p>\n
It would, therefore, be a Constituent Assembly dedicated to overcoming transitional provisionality and democratically defining the orientation of the refoundation of the country in order to avoid the multi-crisis that shakes this society and to recreate institutional legitimacy and collective well-being. An essentially programmatic Constituent Assembly.<\/p>\n
This new political struggle must see beyond the curve. He needs a North.<\/p>\n
